“Challenges and policy dilemmas in the digital services under the new EU framework (DSA-DMA) for markets, competition, and businesses”

The discussion will deal with the key challenges and policy issues in the digital services under the new EU digital legislative framework for markets, competition, and businesses. On 15 December 2020, the European Commission proposed the Digital Services Act package, which includes the Digital Services Act (DSA) and the Digital Markets Act (DMA). The former focuses on new rules for controlling illegal or potentially harmful content online, imposing online providers' liability for third-party content, inspecting obligations of third-party suppliers, and protecting fundamental rights online. The latter mainly regards the behaviour of gatekeepers setting several prohibitions and responsibilities, including prominence issues and data sharing. This event aims to shed light on the expected effect of DSA on SMEs and startups and the relationship of business digitalization and DSA, considering the digital gap between Northern and Southern Europe.

Furthermore, the final impact on research and innovation activities is worthy of further investigation and the DSA influence on competition and the top priorities for competition authorities. Another key issue of DSA is the distinction between different categories of intermediaries and the further clarification of several legal terms such as the definition of illegal content. Finally, the implications of global digital trade and foreign investment in the EU are also critical matters under the scope of DSA.
